1. About us and these terms
1.1 This website, alexhoran.co.uk, is run by Alex Horan, an individual artist based in London, England ("we", "us", "our").
1.2 You can contact us at info@alexhoran.co.uk. We aim to reply within 5 working days.
1.3 These terms apply to every order you place through alexhoran.co.uk. Please read them before ordering. By placing an order, you agree to them.
1.4 Our Refund Policy and Privacy Policy also apply and form part of these terms.
1.5 If you buy as a consumer, nothing in these terms affects your statutory rights, including those under the Consumer Rights Act 2015.
2. Our handmade weavings
2.1 Every piece is designed and woven by hand. Most are one of a kind, so the item you receive is the exact piece shown, unless the listing says it is made to order.
2.2 Handmade work naturally varies. Small irregularities in tension, edges, texture and yarn are part of the character of each piece. They are not faults.
2.3 We photograph our work carefully, but colours can look different depending on your screen and lighting. Natural and hand-dyed fibres can also vary from batch to batch.
2.4 Measurements are approximate and may vary.
2.5 Some pieces include natural materials such as wool, cotton, linen, wood or dried plant fibres.
3. Placing an order
3.1 When you place an order, you make an offer to buy. We will email you to acknowledge it. That email does not mean we have accepted your order.
3.2 A contract between us forms only when we email to confirm your order has been dispatched (or, for commissions, when we confirm the commission in writing and receive your deposit).
3.3 Because most pieces are unique, an item could occasionally sell to someone else before your order is processed. If we cannot accept your order for this or any other reason, we will tell you and refund any payment in full.
3.4 Please check your order details, including your delivery address, before you submit. Contact us as soon as possible if something is wrong.
4. Prices and payment
4.1 Prices are shown in pounds sterling (GBP). Delivery charges are not included in the price.
4.2 We may change prices at any time, but changes will not affect orders already placed.
4.3 If we list an item at a clearly wrong price by mistake, we will contact you. You can then buy at the correct price or cancel for a full refund.
4.4 Payment is taken in full when you place your order, through Shopify Payments / Stripe / PayPal. We never see or store your full card details.
4.5 Orders outside the UK may be subject to import duties, taxes and customs fees in the destination country. These are your responsibility unless the checkout says otherwise.
5. Commissions and custom pieces
5.1 We accept a limited number of commissions. Before we start, we will agree in writing the design brief, size, colours, materials, price and an estimated completion date.
5.2 A non-refundable deposit of 50% is due before work begins. It covers design time and materials bought for your piece. The remaining balance is due before dispatch.
5.3 We may share sketches, sample swatches or progress photos. Changes requested after weaving starts may add cost and time; we will confirm both before going ahead.
5.4 Completion dates are estimates. Handweaving is slow and we will keep you updated if timing changes.
5.5 Commissions are made to your specification, so the 14-day cancellation right does not apply to them once work has begun. See our Refund Policy.
5.6 Unless we agree otherwise, we may photograph commissioned pieces and share them in our portfolio and on social media.
6. Delivery
6.1 Ready-to-ship pieces are usually dispatched within 5-10 working days. Delivery times after dispatch are the carrier's estimates and are not guaranteed.
6.2 Every piece is wrapped and packed with care and sent with tracking. Please check your parcel on arrival and tell us within 24 hours if it is damaged, with photos of the packaging and the piece.
6.3 If you are not in when the carrier calls, follow their instructions to rearrange delivery or collect. If a parcel is returned to us because the address was wrong or it was not collected, we may charge the cost of re-sending it.
6.4 The piece is at our risk until it is delivered to you or someone you nominate. You own it once we have received full payment.
7. Cancellations, returns and faulty items
7.1 If you are a consumer, you normally have the right to cancel within 14 days of receiving your order, except for commissioned or personalised pieces.
7.2 How to cancel, how to return an item, who pays return postage and when you will be refunded are all set out in our Refund Policy. If the Refund Policy and these terms ever conflict, the Refund Policy applies to returns and refunds.
8. Caring for your weaving
8.1 Each piece comes with care instructions. Following them will help it last for many years.
8.2 In general: keep weavings out of direct sunlight to stop colours fading, away from damp and direct heat, and dust them gently with a feather duster. Do not machine wash.
8.3 We are not responsible for wear, fading, shrinkage or damage caused by ordinary use over time, accidents, or not following the care instructions.
9. Copyright and designs
9.1 The artist owns the copyright and all other intellectual property in every design, weaving, photograph and piece of text on this website, including commissioned designs.
9.2 Buying a weaving gives you ownership of that physical piece. It does not give you any right to copy, reproduce or sell the design, or to use images of it for commercial purposes, without our written permission.
9.3 You are welcome to share photos of your piece in your home on social media. We'd love it if you tagged us at @alex.h.art.
10. Our responsibility to you
10.1 If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to take reasonable care. We are not responsible for loss that was not foreseeable.
10.2 We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for breach of your statutory rights as a consumer.
10.3 Our pieces are decorative and intended for domestic and private use. If you buy for business or resale purposes, we are not liable for any loss of profit, business or opportunity, and our total liability to you is limited to the price you paid for the order.
10.4 Wall hangings should be hung using fixings suitable for the weight of the piece and your wall. We are not responsible for damage caused by unsuitable installation.
11. Using this website
11.1 We try to keep the website accurate and available, but we do not guarantee it will always be error-free or uninterrupted.
11.2 You must not misuse the website, for example by introducing viruses, attempting to gain unauthorised access, or copying content in bulk.
12. Your personal information
We use your personal information only as set out in our Privacy Policy, and in line with UK data protection law.
13. Events outside our control
We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as postal strikes, severe weather or supplier failures. If this happens we will contact you, and you may cancel and receive a refund for anything not yet delivered.
14. Questions and complaints
If you have a question or complaint, please email info@alexhoran.co.uk. We will acknowledge it within 5 working days and aim to resolve it within 15 working days.
15. Changes to these terms
We may update these terms from time to time. The version in force when you place your order is the one that applies to it. The date at the top of this page shows when they were last updated.
16. General
16.1 If a court finds any part of these terms invalid, the rest will still apply.
16.2 If we do not enforce a right straight away, we can still enforce it later.
16.3 These terms are between you and us. No one else has any right to enforce them.
16.4 These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
